An exact quote from a comment (http://www.rockpapershotgun.com/2014/06/17/minecraft-not-worse-than-ea/#comment-1598839) under that RPS article, in fact:
"Eh, servers can keep doing what they were doing and Mojang would have to test the EULA in court, and afaik that’s never been done, so the whole concept of the EULA might be invalidated. Hooray!"
That's not the only comment similar to that that I've seen, though. I think these guys are in for a rude awakening if they think Mojang would lose this.
