Happy Birthday Apparently Public Domain After All
Well isn't this enlightening.
We'll forget how the documents that prove it should have been turned over by Warner over a year ago during the initial discovery phase of the trial, rather than a couple of weeks prior to a final ruling. You'd almost think they were hoping the plaintiff would run out of cash and be forced to withdraw their case. If this evidence was presented back when it was suppose to be, I doubt they'd even have to see the inside of a courtroom, as it's pretty damning evidence, a lot of evidence at that (This wasn't them misplacing a scrap of paper), and it's probably looking right about now that Warner had tried to mislead the court.
A shame for Warner if this works out the way it -should-. That's about 2 million per year of hassling folks out of licensing fees they had no right to collect simply gone!
Perhaps it means we'll start seeing the song sung much more commonly in movies and the like rather than all the substitutes that are commonly sung to get around the fees.

If absolutely nothing else, instead of them not only losing that $2,000,000 per year(!!!) revenue stream that they illegitimately got from the song, I hope they actually have to pay that back to all the people that they essentially stole it from. We can hope, at least. That'll probably require a separate class action suit against them, though. IANAL.
My guess, though, is that nothing more than, at most, maybe a mild slap on the wrist will be the result of this against Warner. Here's to hoping that I'm wrong to be jaded and cynical in this case, though. I'd much rather feel some good old fashioned schadenfreude against them over this. ¬_¬
